David K. Wilson
David has practised for over 25 years in the areas of litigation, public law and international trade law. He joined CWCB as a partner in October 2010 after practising at two large national firms.
David regularly appears before the Federal Court and Supreme Court of Canada and has argued trade and public law cases before the courts in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, New Brunswick and the Northwest Territories. David represents clients on a broad range of complex WTO and NAFTA issues and disputes and advises on international market access, investment and trade negotiation issues.
David acts for clients before a number of federal regulatory tribunals including the Canadian International Trade Tribunal, the Patented Medicine Prices Review Board, the Canadian Transportation Agency, Canadian Radio-Television and Telecommunications Commission, the Canadian Nuclear Safety Commission, National Energy Board, Competition Tribunal and the Farm Products Council of Canada.
Drawing on his constitutional, administrative law and legislative drafting experience, David assists clients in their dealings with federal departments and agencies, including Foreign Affairs and International Trade, Agriculture and Agri-Food, Transport Canada, Canada Border Services Agency, Industry Canada, Public Works, Health Canada, the Pest Management Regulatory Agency and the Canadian Food Inspection Agency.
David's experience includes:
- Supreme Court of Canada constitutional (division of powers and Charter) and administrative law cases.
- Federal Court of Appeal, Federal Court, Ontario Court of Appeal, Ontario Divisional Court and other provincial courts in various public law cases, including an Investment Canada Act dispute, constitutional and administrative law cases, federal environmental assessment, access to information and privacy and federal-provincial disputes.
- International (WTO and GATT) trade disputes, NAFTA Chapters 11, 18, 19 and 20 disputes and domestic Agreement on Internal Trade disputes.
- Safeguard, anti-dumping and countervailing duty proceedings before Canadian International Trade Disputes, including related appeals to Federal Court of Appeal and government procurement cases.
- Specialised federal law areas including negotiation of federal-provincial agreements, drug pricing, regulatory drafting, food labelling and standards, misleading advertising, regulated conduct defence, transportation security, pesticide regulation, regulation of toxic chemicals.
David received his LL.B. from the University of British Columbia before clerking for the Honourable Justice McIntyre at the Supreme Court of Canada. He has been an instructor for the Law Society of Upper Canada's Bar Admission Course (Public Law).
David has written and spoken extensively on issues related to international trade and public law and has coached the Gale Cup Moot Team at the University of Ottawa Law School.
